Terms of Service for Design and Branding Services

1. Introduction

Welcome to the Terms of Service (TOS) for the design and branding services provided by Tony Hughes | Tony Hughes Design. These terms govern your use of our services. By engaging our Services, you agree to these terms in full.

2. Services Offered

• Design Services: Logo, website, business cards, etc.
• Branding Services: Strategy, identity, collateral.
• Custom Services: Upon request with separate terms.

3. Intellectual Property Rights

Ownership: Full ownership transfers on full payment. We retain portfolio use unless agreed otherwise. Licence: Clients receive a limited, non-transferable, perpetual licence for use. Third-Party Assets: Client must ensure licences for stock fonts/images are valid.

4. Payment Terms

• Fees: 50% deposit, balance before delivery.
• Methods: Bank, credit card, crypto (BTC, ETH, DOT).
• Late Payment: Monthly late fee may apply. Work may pause.

5. Revisions & Approvals

Includes 3 revision rounds. Additional revisions billed hourly (€200). Final approval in writing required.

6. Client Responsibilities

Provide all needed materials and feedback promptly to avoid delays or extra charges.

7. Confidentiality

Both parties must maintain confidentiality. We reserve the right to showcase the work.

8. Termination

Clients may cancel any time. Fees apply for work completed. We may also terminate if obligations are not met.

9. Liability

No warranties are provided. Our liability is capped at the amount paid. No liability for indirect damages.

10. Disputes

Latvian law applies. Disputes resolved through mediation/arbitration in Latvia.

11. Amendments

We may update these terms. Continued use implies acceptance.
